Equal Opportunity Commission Of Trinidad And Tobago
The Equal Opportunity Commission’s mandate is to work towards eliminating discrimination and promoting equality and good relations between persons of different statuses. The EOC was established by Section 26(1) of the Equal Opportunity Act (the Act), for the purpose of exercising the jurisdiction conferred upon it by that Act. A person who believes that they have been subjected to discrimination may lodge a complaint with the EOC. The EOC is mandated to receive, investigate and as far as possible, conciliate complaints. The EOC investigates every complaint lodged. Services at the EOC are free of charge up until the stage of conciliation. If the matter is unresolved, the complaint can be referred to the Equal Opportunity Tribunal (EOT). The EOT is a superior court of record and its mandate is to hear and adjudicate on matters referred to it by the EOC. The EOT has the power to make orders, declarations and awards of compensation as it determines to be appropriate. The Act seeks to protect persons against discrimination under four categories: • Employment • Education • Provision of Goods and Services • Provision of Accommodation Under the Act, persons are entitled to equality and fair treatment, despite their status. The seven status grounds covered by the Act are: • Race • Ethnicity • Religion • Marital status • Origin including geographical origin • Disability • Sex The Act also covers victimization and offensive behaviour. The EOC has called for the Act to be amended to include: • AGE as a status of discrimination • SEXUAL ORIENTATION as a status of discrimination • The expansion of the definition of DISABILITY • The inclusion of HIV/AIDS, Cancer, and Multiple Sclerosis as disabilities • The inclusion of CO-HABITATIONAL RELATIONSHIPS on the grounds of marital status • The inclusion of HALF-BLOOD RELATIONSHIPS in the definition of family Click link below to access the Act: https://rgd.legalaffairs.gov.tt/laws2/alphabetical_list/lawspdfs/22.03.pdf
