IME Pension Fund (ASSEP) is a cross-border Occupational Retirement Provision (IORP) vehicle that offers pension solutions to multiple employers across EU Member States. As a cross-border IORP, it operates under a dual regulatory framework: Prudential Regulation: Governed by the rules of the home Member State, which is Luxembourg in this case. This includes financial supervision, governance, investment restrictions, and funding requirements under the oversight of the Commission de Surveillance du Secteur Financier (CSSF). Social and Labour Law (SLL): The host Member State’s rules apply to each affiliated employer, specifically regarding conditions such as vesting, retirement age, and benefit entitlements. This ensures that local employee protection standards are respected. This structure enables the IME Pension Fund to provide a harmonised yet locally compliant occupational pension arrangement across different jurisdictions, making it an attractive solution for multinational employers seeking efficient cross-border pension management under the EU IORP II Directive framework.
